APPENDIX C INVENTION DISCLOSURE TO ATTORNEY

This form is designed to enable the inventor to provide the patent practitioner (attorney or agent) with pertinent information about his invention in advance of the first meeting. Attach additional sheets as necessary.

The Most Important Questions:
  • Has the invention or products made by the invention been sold, offered for sale, publicly disclosed or displayed, subjected to publication, actually sold, advertised, tested with supervision, tested without supervision, or used? If so, notify a patent practitioner/attorney immediately.
  • Are any public displays, trade shows, or publications concerning the invention planned? If so, please contact a patent practitioner immediately. Public disclosure, public use, sales or offers for sale, prior to the filing of a patent application can prevent the inventor from being able to obtain enforceable patents in foreign countries.

INVENTORSHIP

Please list the names, addresses (including county), telephone numbers, employers, and citizenships of all persons (do not list companies or corporations as inventors, but do list the names of the employers of inventors) who have made any sort of creative contribution to the invention. Only those persons who conceived of or contributed to the invention may apply for a patent as an inventor.

OWNERSHIP

Does any person or company other than the inventors listed above own any interest or percentage in the invention? . If so, the name of that person or company is:

CONCEPTION

  • It is likely that improvements have been made to the invention since the conception date. Please list the name of each improvement next to the date of each improvement, and attach copies of the first drawings or sketches of these improvements:
  • If any experiments or performance test were performed on the invention, please list the dates, the subject of and the nature of these experiments. Include the names of the witnesses or persons involved in the experiments:

UTILITY OF THE INVENTION

  • Identify the uses of the invention, including any commercial or scientific uses of the invention, and the markets in which the invention might be sold:

PRIOR ART

The prior art generally includes all other patents, publications, and products in public use or in existence at the time the invention is conceived. Everyone who is substantially involved with the invention has an obligation to disclose to the patent office any relevant prior art of which he is aware both before filing and during the prosecution of the patent application. Failing to do so may result in an unenforceable patent.

If the invention or products made by the invention has been sold, offered for sale, publicly disclosed or displayed, subjected to publication, actually sold, advertised, tested with supervision, or tested without supervision, please provide a detailed description of the circumstances surrounding of each event, the date and location of the event, and the names of all persons involved in or present at the event. Events which occurred earlier than about one year ago should be described in as much detail as possible.

Please list any public displays, trade shows, or publications concerning the invention which are planned, including the nature of the event and the date. Again, public disclosure, public use, sales or offers for sale prior to the filing of a patent application can prevent the inventor(s) from being able to obtain enforceable patents in foreign countries.

OBVIOUSNESS

(this section is optional, but should be nevertheless completed prior to filing a patent application) Please describe any prior art solutions to the problems the invention solves, overcomes or reduces, including information about how long the problems have existed, how the problems are ordinarily dealt with, and how the invention solves, overcomes, or reduces these problems.

  • Attach any related articles published by the inventor(s) and others in this or related fields which might have some bearing on the invention, or which might be helpful for the practitioner to understand the technology.
